00 The Laramie County Board of Commissioners met in
regular session Tuesday, April 21, 2009. Those in
attendance were Commissioner Jeff Ketcham, Chairman;
Commissioner Diane Humphrey, Vice Chairman;
Commissioner Gay Woodhouse; County Attorney Mark
Voss; Deputy County Attorney Sylvia Hackl; County Clerk
Debbye Lathrop; Chief Deputy County Clerk Rhonda Bush.

Those signing the register were Laurell Fogg; Calvin
Fogg; Don Beard, Laramie County Public Works; John
Steil, Steil Surveying; Marlene Aitchison, Laramie County
Fire District No. 2; Robin Werner, City of Cheyenne
Development Office; Bobbie Swanlund, American Legion
Auxiliary; Julie Rust, American Legion Auxiliary; Freeda
Warren, American Legion Auxiliary.

01 Commissioner Humphrey moved to approve the Minutes
of Proceedings for April 7, 2009. Commissioner
Woodhouse seconded the motion, which passed
unanimously.

02 Commissioner Woodhouse moved to approve the 2009
Wildland Fire Management Annual Operating Plan for
Laramie County. Commissioner Humphrey seconded the
motion, which passed unanimously. After obtaining all
signatures, the Plan is to be filed in central files with the
County Clerk.

03 Commissioner Woodhouse moved to approve of the
disposal of various computer equipment submitted by
Information Technology. Commissioner Humphrey
seconded the motion, which passed unanimously.

04 Commissioner Woodhouse moved to approve a fire and
life safety maintenance agreement and inspection
agreement between Laramie County and Phoenix Fire
Protection for the Laramie County Detention Facility in
the amount of $14,314.68 to run July 1, 2009 through
June 30, 2010. Commissioner Humphrey seconded the
motion, which passed unanimously. The agreement is
filed in central files with the County Clerk.

05 Commissioner Humphrey recused herself from acting on
this item. Public Works Director Don Beard presented a
petition to rename County Road 135 to Dean Fogg Road
and recommended approval. Commissioner Ketcham
referred to a letter submitted by Charles "Skip" Eshleman
asking for items such as fencing and cattle guards. Mr.
Beard stated that damages under this action would be
related to a change in addressing. County Attorney Mark
Voss went over the process for a name change on a road
and in his opinion, after reading the letter, Mr. Eshleman
is not asking for any financial damages, nor does he have
an address on this road. Mr. Eshleman is asking for
improvements to the road, but the road is not being
altered. Mr. Voss stated the Commissioners could decide
to continue the public hearing or address it today.
Chairman Ketcham asked if this would require two actions;
one to deny claims and another to approve the petition to
which Mr. Voss responded that was correct. Chairman
Ketcham opened the meeting as a PUBLIC HEARING.
Hearing no public comment, the Chairman closed the
PUBLIC HEARING. Commissioner Woodhouse asked for
clarification on the road to which the petition applied. Mr.
Beard clarified that it was Road 135 and not Road 209 as
in the viewer's report. Commissioner Woodhouse moved
to deny the request of Mr. Eshleman. Chairman Ketcham
seconded the motion, which passed unanimously.
Commissioner Woodhouse moved to approve the road
petition to rename County Road 135 Dean Fogg Road.
Chairman Ketcham seconded the motion, which passed
unanimously. The resolution is to be filed in central files
with the County Clerk.

06 Laramie County Fire District #2 Chief, Marlene Aitchison,
presented a request for $110,000 of fifth penny funds to
be used to complete the interior construction on the
station addition at 5800 North College Drive. The funds
will be used to finish office space, restrooms, and a
training classroom. If approved, they will go through a
request for proposal and bid process. Chairman Ketcham
asked if the Fire District would have any matching funds in
the project. Ms. Aitchison responded that over $300,000
of construction costs have already been paid directly from
fire district funds. Commissioner Humphrey moved to
approve $110,000 of fifth penny funds for completion of
interior construction. Commissioner Woodhouse seconded
the motion, which passed unanimously.

07 County Clerk Debbye Lathrop presented a new Fireworks
Permit Application submitted by Jeff Williams d/b/a
Wyoming Fireworks Warehouse located at 12700 I-80
Service Road, Cheyenne, Wyoming 82009. Chairman
Ketcham opened the meeting as a PUBLIC HEARING.
Hearing no comment, the Chairman closed the PUBLIC
HEARING. Commissioner Woodhouse moved to approve
the Fireworks Permit. Commissioner Humphrey seconded
the motion, which passed unanimously. Documentation is
filed in central files with the County Clerk.

08 Dennis Dawson, AVI Engineering, presented a Preliminary
Plat application for the right-of-way for Road 124 from
U.S. 85 to the North line of Section 31, T.16N., R.66W.,
and Section 36, T.16N., R.67W., 6th P.M., Laramie
County, Wyoming. Mr. Dawson gave a history of the
statutory requirements for state highways and a history of
the right of way along Road 124. The purpose of this plat
is to establish a good chain of title on this right of way to
prevent future problems. Commissioner Woodhouse asked
if the plat would be recorded with metes and bounds
legal descriptions. Mr. Dawson stated that it would be
recorded with the legals as shown on the plat. Public
Works Director Don Beard reported that when the state
gave this right of way to the County, there were already
issues and he supports the plat. County Planner Gary
Kranse reported that this plat does meet the requirements
of Section 50.000 of the Cheyenne and Laramie County
Subdivision Development Regulations, 2000 and
recommends acknowledge of the preliminary plat, after
which the final plat would go through the process.
Chairman Ketcham opened the meeting as a PUBLIC
HEARING. Hearing no public comment, the Chairman
closed the PUBLIC HEARING. Commissioner Woodhouse
moved to acknowledge receipt of the Preliminary Plat
without conditions and accept the staff report with
recommendation a. Commissioner Humphrey seconded
the motion, which passed unanimously.

09 There was no action required for the withdrawal of an
application for a Final Plat and Subdivision Permit for
Jefferson Hills Subdivision, a portion of Lot 1, Block 1, Ley
Subdivision and Tract 2, Hermann Meadows Subdivision,
Laramie County, Wyoming.

10 There was no action required for the withdrawal of the
Preliminary Plat for Foxtail Subdivision, a replat of a Tract
6, and a portion of Tract 7, Allison Tracts, Laramie
County, Wyoming.

11 There was no action required for the withdrawal regarding
a change in Zone from MR-2 to HR-2 for the proposed
Foxtail Subdivision, a replat of a Tract 6, and a portion of
Tract 7, Allison Tracts, Laramie County, Wyoming.

The meeting adjourned at 4:09 p.m.

00 The Laramie County Board of Commissioners met in
regular session Tuesday, April 7, 2009. Those in
attendance were Commissioner Jeff Ketcham, Chairman;
Commissioner Gay Woodhouse; Deputy County Attorney
Sylvia Hackl; County Clerk Debbye Lathrop; Chief Deputy
County Clerk Rhonda Bush.

01 Commissioner Woodhouse moved to approve the Minutes
of Proceedings for March 17, 2009. Commissioner
Ketcham seconded the motion, which passed
unanimously.

02 Commissioner Woodhouse moved to approve warrants in
the amount of $1,612,255.09 for March 2009.
Commissioner Ketcham seconded the motion, which
passed unanimously. Documentation is filed in central
files with the County Clerk.
03 Commissioner Woodhouse moved to approve the
following fees collected by various County agencies for
February 2009: Circuit Court, $67,823.00; Clerk of District
Court, $17,242.39; Planning & Development, $21,516.16;
County Clerk, $67,971.06; Sheriff's Department,
$62,545.18. Commissioner Ketcham seconded the
motion, which passed unanimously. Documentation is
filed in central files with the County Clerk.

04 Commissioner Woodhouse moved to approve a malt
beverage permit submitted by Robert E. Stoddard VFW
Post 4343 located at 3216 South Greeley to serve
beverages in the hall during the 50th anniversary April 10,
2009. Commissioner Ketcham seconded the motion,
which passed unanimously. Documentation is filed in
central files with the County Clerk.

05 Commissioner Woodhouse moved to approve the
following part-time salaries in the amount of $32,238.26
for March 2009: Public Works, $1,690.00; Extension
Agent, $2,306.82; Buildings & Grounds, $10,464.04;
Information Technology, $1,000.00; County Treasurer,
$4,183.34; Detention Center, $10,094.06; District Court,
$550.00; Coroner, $1,950.00. Commissioner Ketcham
seconded the motion, which passed unanimously.

06 Commissioner Woodhouse moved to approve a resolution
authorizing the submission of a grant application by the
Laramie County Board of Commissioners to the Wyoming
Attorney General Office's Division of Victim Services for
funding to support the Laramie County Victim Assistance
Program in the amount of $56,785 with an $8,733 match
to run through June 30, 2010. Commissioner Ketcham
seconded the motion, which passed unanimously. The
resolution is filed in central files with the County Clerk.

07 Commissioner Woodhouse moved to approve an
addendum to modify the maintenance agreement
between Laramie County and Identix, Inc. (080520-15) in
the amount of $6,042 to run June 1, 2009 to May 31,
2010. Commissioner Ketcham seconded the motion,
which passed unanimously. The addendum is filed in
central files with the County Clerk.

08 Commissioner Woodhouse moved to approve an
amendment to the Food Service Contract (070220-22)
between Laramie County and CBM Foodservice for the
Laramie County Detention Center increasing the cost from
$1.61 to $1.70 per meal to run July 1, 2009 through June
30, 2010. Commissioner Ketcham seconded the motion,
which passed unanimously. The amendment is filed in
central files with the County Clerk.
09 Commissioner Woodhouse moved to approve a quarterly
report for Bureau of Justice Assistance grant 2007-DJ-BX-
1399. Commissioner Ketcham seconded the motion,
which passed unanimously. The report is filed in central
files with the County Clerk.

10 Commissioner Woodhouse moved to approve acceptance
for the Emergency Management Performance Grant
(EMPG) 09-GPD-LAR-EM-GCF9 in the amount of $29,042
to run October 1, 2008 to June 30, 2010. Commissioner
Ketcham seconded the motion, which passed
unanimously. After obtaining all signatures, the grant is to
be filed in central files with the County Clerk.

11 Chairman Ketcham opened the meeting as a PUBLIC
HEARING to discuss the proposed grant application(s) for
the second round of funding for 2009 Community
Development Block (CDBG) Program available from the
Wyoming Community Development Authority (WCDA).
Hearing no public comment, the Chairman closed the
PUBLIC HEARING.

12 Agent for the applicant, John Steil, stated that the road
petition had been accepted, the viewer's report had been
presented, and a public hearing had been held.
Easements have been prepared for review by the County
Attorney prior to being recorded. Chairman Ketcham
opened the meeting as a PUBLIC HEARING for claims for
damages regarding Road Petition 430 vacating a public
right-of-way known as Sycamore Road located between
Skyline Drive and Montclair Drive in Skyline Tracts.
Hearing no public comment, the Chairman closed the
PUBLIC HEARING. Commissioner Woodhouse moved to
approve Road Petition 430 with no assessment of
damages and subject to the easements being signed off
on by the County Attorney. Commissioner Ketcham
seconded the motion, which passed unanimously. The
resolution is to be recorded in the Recording Department.

13 County Planner Gary Kranse presented an overview of the
Laramie County Facility Study and Archer Master Plan.
The study began in November, 2008. He thanked all the
elected officials, their staff members, and outside boards
and agencies for their assistance and cooperation in
gathering necessary data for the 20-year plan. Mr. Kranse
introduced Rich Siterelle of the DLR Group, who provided
a slide presentation showing the overall master plan of the
Archer property. Mr. Kranse gave a brief analysis of the
costs for development and the next steps after adoption of
the plan. Phase I consists of the shooting park, public
works, administrative offices, and then the infrastructure of
roads, water and sewer. It also includes working with High
West Energy on other utilities. Commissioner Ketcham
asked if the current estimates have an inflation factor built
in to which Mr. Kranse responded their was an inflation
factor built in as well as the estimates themselves being
very conservative. He also stated that the actual
construction would likely begin in the spring of 2010.
Chairman Ketcham opened the meeting for public
comment. Paula Qualls stated she believes this is a
fantastic plan, and the citizen's needs are well represented
by replacing the motocross track and creating a public
shooting range. Hearing no other public comment, the
Chairman closed the public comment period.
Commissioner Woodhouse moved to accept the Laramie
County Facility Study and formally adopt the Archer
Master Plan as a guide for development of the Archer
complex. Commissioner Ketcham seconded the motion
which passed unanimously. The report is filed in central
files with the County Clerk.

14 Commissioner Woodhouse moved to approve a resolution
approving submission of a grant application from the
Laramie County Board of Commissioners to the Wyoming
Community Development Authority for Community
Development Block Grant Funds in the amount of
$200,000 with a $20,000 match to fund the Laramie
County Home Rehabilitation Program. Commissioner
Ketcham seconded the motion, which passed
unanimously. The resolution is filed in central files with
the County Clerk.

15 Public Works Director Don Beard requested the
Memorandum of Understanding between Wyoming
Department of Transportation and Laramie County to
purchase reclaimed asphalt pavement for federal project
1251156 (Cheyenne/Chugwater/Whitaker Section) in the
amount of $185,505 with payment to be deducted from
legislative approved funding for RAP material be
withdrawn from consideration due to lack of funding from
the state legislature. Commissioner Woodhouse moved to
withdrawn consideration of the MOU with the Wyoming
Department of Transportation to purchase reclaimed
asphalt pavement. Commissioner Ketcham seconded the
motion, which passed unanimously.

16 Kevin Tremor, Cheyenne Transit Program, presented a
Memorandum of Understanding between Laramie County
and the City of Cheyenne to provide a means for the CTP
to provide public transportation service to Laramie County
Community College, the City/County Health Department,
and for an area of Laramie County immediately adjacent
to the City of Cheyenne in the amount of $71,347.65 for
Fiscal Year 2010. The contract price includes a 10
percent increase over the current contract price.
Commissioner Woodhouse moved to approve the
Memorandum of Understanding between Laramie County
and the City of Cheyenne to fund the Cheyenne Transit
Program in the amount of $71,347.65 to be paid in four
installments for fiscal year 2010. Commissioner Ketcham
seconded the motion, which passed unanimously. After
obtaining all signatures, the MOU is to be filed in central
files with the County Clerk.

17 Commissioner Woodhouse moved to approve an
agreement between Laramie County and the City of
Cheyenne for payments from Laramie County's FY 2008
grant award from the US Department of Justice in the
amount of $83,000 to provide two juvenile compliance
and diversion officers employed by the Cheyenne Police
Department for a period of April 1, 2009 to March 31,
2010. Commissioner Ketcham seconded the motion,
which passed unanimously. The agreement is filed in
central files with the County Clerk.

18 Commissioner Woodhouse moved to approve a
construction change order (# 3) for the Allison Draw Flood
Channel, Orchard Valley Phase between Laramie County
and NRCS in the amount of $38,090 to grout rock riprap
and extending the substantial completion date from April
15, 2009 to May 8, 2009. Commissioner Ketcham
seconded the motion, which passed unanimously. The
change order is filed in central files with the County Clerk.

19 County Clerk Debbye Lathrop presented a Seasonal
Fireworks Permit application submitted by Jim Landis
d/b/a USA Fireworks located at 102 West College Drive.
Chairman Ketcham opened the meeting as a PUBLIC
HEARING. Paula Qualls, 2316 South Fifth Avenue and
the SCCDA, wanted it on record that South Cheyenne
would like to have no fireworks outlets in that part of town,
particularly those located on the entry routes. Hearing no
other comment, the Chairman closed the PUBLIC
HEARING. Commissioner Woodhouse moved to approve
the Seasonal Fireworks Permit application submitted by
Jim Landis d/b/a USA Fireworks. Commissioner Ketcham
seconded the motion, which passed unanimously.

20 Human Resource Director Heather Rudy presented the four
responses to the bid request for health insurance
coverage. Two of the companies would have required
over $1 million in additional annual premiums to match
the current coverage we have with WINhealth Partners.
The recommendation is to go with WINhealth as their bid
represented a six percent increase, which is under the
national average. Commissioner Woodhouse moved to
approve the bid submitted by WINhealth Partners for
County health insurance following the 2009 bid process.
Commissioner Ketcham seconded the motion, which
passed unanimously. The bids were not received into
record.

21 Eddie Davidson, representing Interstate Highway,
presented a temporary use permit for a concrete batch
plant located on a portion of Section 35, T.14N., R.67W.
of the 6th P.M., Laramie County, Wyoming (located
between State Street and Old Happy Jack Road). Mr.
Davidson requested the permit be written for future
extensions. County Planner Gary Kranse stated a 30-day
permit has already been issued. The permit request today
would run through November 30, 2009 with a request that
the grounds are returned to their original condition and
with the provision that the County Planning Department
could authorize extensions for up to twelve months.
Chairman Ketcham opened the meeting as a PUBLIC
HEARING. Hearing no public comment, Chairman
Ketcham closed the PUBLIC HEARING. Commissioner
Woodhouse moved to approve a temporary use permit for
a concrete batch plant located on a portion of Section 35,
T.14N., R.67W. of the 6th P.M., Laramie County,
Wyoming (located between State Street and Old Happy
Jack Road) with conditions 1 through 3 and adopting
findings of fact a-c of the staff report. Commissioner
Ketcham seconded the motion, which passed
unanimously. The resolution is to be recorded in the
Recording Department.
22 John Steil, agent for the applicant, presented a Final Plat
and Subdivision Permit Application for Travel Centers of
America, 2nd filing Subdivision, located in a portion of
the SW1/4 of Section 23, T.14N., R.64W., of the 6th P.M.,
Laramie County, Wyoming. The tract is 18.2 acres and
has never been platted. This action will bring the property
into compliance with current regulations. County Planner
Gary Kranse presented the staff report and recommended
approval subject to payment of community development
fees and a) This application meets the general platting
requirements, pursuant to Section 30.000 of the
Cheyenne and Laramie County Subdivision and
Development Regulations, 2000; b) This application
meets the requirements for a Final Plat, pursuant to
Section 60.000 of the Cheyenne and Laramie County
Subdivision and Development Regulations, 2000; c) This
application meets the criteria for a subdivision permit,
pursuant to Section 70.000 of the Cheyenne and Laramie
County Subdivision/Development 2000. Chairman
Ketcham opened the meeting as a PUBLIC HEARING.
Hearing no public comment, the Chairman closed the
PUBLIC HEARING. Commissioner Woodhouse moved to
approve the Final Plat and Subdivision Permit
Application for Travel Centers of America, 2nd filing
Subdivision, located in a portion of the SW1/4 of Section
23, T.14N., R.64W., of the 6th P.M., Laramie County,
Wyoming with the condition of payment of community
development fees and recommendations a) through c).
Commissioner Ketcham seconded the motion, which
passed unanimously. The resolution is to be recorded in
the Recording Department.

23 Commissioner Woodhouse moved to approve a resolution
approving the submission of a grant application to the
U.S. Department of Justice for COPS hiring recovery
program funds in the amount of $1,382,920 for a period of
three years beginning July 1, 2009 and ending June 30,
2012. The resolution is filed in central files with the
County Clerk.
