00 The Laramie County Commissioners met in regular
session Tuesday, April 19, 2011 at 3:30 p.m. Those in
attendance were Commissioner Diane Humphrey,
Chairman; Commissioner Gay Woodhouse, Vice
Chairman; Commissioner Troy Thompson; County
Attorney Mark Voss; Deputy County Attorney Sylvia Hackl;
Laramie County Clerk Debbye Lathrop and Chief Deputy
County Clerk Rhonda Bush.

01 Commissioner Woodhouse moved to approve the Minutes
of Proceedings for April 5, 2011. Commissioner
Thompson seconded the motion, which passed
unanimously.

02 Commissioner Thompson moved to approve an
agreement between Laramie County and Powell Title &
Escrow for access to the Laramie County Clerks' Recording
System with a one-time set up fee of $800 and a monthly
usage fee of $150. Commissioner Woodhouse seconded
the motion, which passed unanimously. The agreement is
filed in central files with the County Clerk.

03 Commissioner Thompson moved to approve a request to
dispose fixed assets (one dumb terminal, personal
computers, and printers) from the Information Technology
Department. Commissioner Woodhouse seconded the
motion, which passed unanimously. Documentation is
filed in central files with the County Clerk.

04 Commissioner Thompson moved to approve an
agreement between Laramie County and Municipal Court
for the Sheriff's Department to provide Courthouse
Security Services in the amount of $3,000 per month.
Commissioner Woodhouse seconded the motion, which
passed unanimously. After obtaining all signatures, the
agreement is to be filed in central files with the County
Clerk.

05 Commissioner Thompson moved to approve an
agreement between Laramie County and EC Power
Systems in the amount of $2,350 per year to run April 19,
2011 through June 30, 2013 to provide inspection and
service for the generators located at the Laramie County
Government Complex and the City/County Health
Department. Commissioner Woodhouse seconded the
motion, which passed unanimously.

06 County Planner Gary Kranse provided background on the
purpose of today's PUBLIC HEARING. The current Public
Works building will be vacated when that department
moves to its new facilities in the Archer Complex. One
political subdivision has expressed an interest in
occupying the existing facility and today's PUBLIC
HEARING is to provide an opportunity for others to express
an interest as well as to provide an opportunity for public
comment on the one proposal. Mr. Kranse stated there
are currently three lots at the site, but the Planning
Department suggests closing off a one-acre parcel from
the largest lot, providing for additional acreage for sale or
development. Aaron Fowler, Chief of Fire District #1,
presented the district's proposal to use the Laramie County
Public Works facility at Fox Farm. Chief Fowler stated the
district's existing facility does not provide ample room for
all the existing apparatus and they would like to have
living quarters for the paid fire fighters. The current Public
Works facility provides ample space for those needs as
well as a location with excellent access onto both
directions of I-80 as well as Fox Farm Road and College
Drive. The district has a SLIB grant to upgrade the
facility. Commissioner Thompson asked if the lot was
broken into two parcels, would the one-acre area still
provide enough area for getting trucks in and out. Chief
Fowler stated that it would. Commissioner Humphrey
opened the meeting as a PUBLIC HEARING. Paula
Qualls, 2316 S. 5th Avenue, stated support for Fire District
#1 to move to the Public Works facility. Hearing no further
comment, the Chairman closed the PUBLIC HEARING.
The Chairman stated that there would be no action taken
at this time.

07 After being asked by County Attorney Mark Voss if the
Board of Commissioners had had time to review the order
and facts and findings, Commissioner Thompson moved
to issue an order granting temporary access in a petition
for private road filed by Shane Edeburn et al.
Commissioner Woodhouse seconded the motion, which
passed unanimously. Documentation is filed in central

08 Commissioner Woodhouse moved to approve a revised
resolution authorizing the submission of a grant
application from the Laramie County Board of
Commissioners to the Wyoming Business Council for
Business Ready Community grant funds on behalf of
COLL-IND-LLC, to include Cheyenne Laramie County
Corporation for Economic Development (LEADS) and
Road Runner Four LLC, in the amount of $1,500,000 for
the purpose of roadway, water and sewer improvements at
the Niobrara Energy Park with match provided by COLL-
IND-LLC. Commissioner Thompson seconded the motion,
which passed unanimously. The resolution is filed in
central files with the County Clerk.

09 County Planner Gary Kranse presented the following
report on change orders for the Archer Complex project in
the amount of $13,473: Adolfson Peterson Wyoming,
$7,950 to provide temporary power to the Juvenile
Services Center job site; FCI, in the amount of $6,864 to
provide wall enclosure around electrical equipment in
area B; FCI, deduct $1,341 for change of aluminum door
hinge. Documentation is filed in central files with the
County Clerk.

10 Commissioner Woodhouse moved to approve a contract
between Laramie County and Qwest to provide high-
speed, fiber optic data transmission equipment and
service throughout the Archer Complex and between
Archer and the Laramie County Government Complex.
($308,000 one-time charge from the specific purpose
optional sales tax account, plus $1,800 monthly recurring
charge for duration of service contract for 10 years with the
monthly charge coming from the Information Technology
budget) Commissioner Thompson seconded the motion,
which passed unanimously. After obtaining all signatures,
the contract is to be filed in central files with the County
Clerk.

11 County Clerk Debbye Lathrop presented a Seasonal
Fireworks Permit submitted by Jeff Williams d/b/a
Wyoming Fireworks Warehouse located at 12700 I-80
Service Road, Cheyenne, WY Chairman Humphrey
opened the meeting as a PUBLIC HEARING. Hearing no
public comment, the Chairman closed the PUBLIC
HEARING. Commissioner Thompson moved to approve
the Seasonal Fireworks Permit. Commissioner Woodhouse
seconded the motion, which passed unanimously.

12 Commissioner Woodhouse moved to approve a resolution
appointing Craig Jones, Deputy District Attorney, to
complete a term as a member of the Laramie County
Community Juvenile Services Joint Powers Board to run
through June 30, 2011. Commissioner Thompson
seconded the motion, which passed unanimously. After
obtaining all signatures, the resolution is to be filed in
central files with the County Clerk.

13 Public Works Director Don Beard presented bids for the
Laramie County Chip Seal 2011 Project. Mr. Beard stated
the engineer's estimate was $631,550 and the following
bids were submitted: Simon Contractors, $602,870; Knife
River, $572,970; Intermountain Slurry Seal, $541,540. Mr.
Beard stated the bid from Intermountain Slurry Seal was
considered non-responsive as it did not contain the list of
subcontractors and suppliers, so the bid was rejected. He
recommended contracting with Knife River, the low
responsive bidder. Commissioner Thompson moved to
accept the bid in the amount of $572,970 from Knife
River. Commissioner Woodhouse seconded the motion,
which passed unanimously. The original bids were not
received into record.

14 Building Maintenance Director Chris Wegner presented
the following bids to remodel the Commissioners
Boardroom and office area: S & S Builders, $60,390;
Reiman Corporation, $57,725; Torix General Contractors,
LLC, $55,655; Edwards General Contractors, Inc.,
$51,250; Richardson Construction, Inc., $46,814; and
Construction Specialists, $46,545. Ms. Wegner
recommended accepting the bid from Construction
Specialists, who will be using the following local
contractors: Pinnacle, Simpson, Sheet Metal, Kizer Corp,
Anderson Painting. There will be an additional electrical
cost at the request of the Information Technology
Department. Ms. Wegner stated this bid does include
recessed monitors. Commissioner Woodhouse moved to
accept the bid from Construction Specialists, Inc. in the
amount of $46,545. Commissioner Thompson seconded
the motion, which passed unanimously. The original bids
were not received into record.

15 Commissioner Thompson moved to approve a hiring
freeze exemption for a temporary part-time administrative
assistant in the Human Resources Department for
coverage during the maternity leave of the Human
Resource Director. Commissioner Woodhouse seconded
the motion, which passed unanimously. Documentation is

16 Commissioner Woodhouse moved to approve a hiring
freeze exemption for 8 temporary laborers for the Public
Works Department. Commissioner Thompson seconded
the motion, which passed unanimously. Documentation is
filed in central files with the County Clerk.

17 Commissioner Thompson moved to approve an
agreement for underground storage tank testing services
contract between Laramie County and CGRS
Environmental Services, Inc. at Laramie County Public
Works in the amount of $1,055 to run April 19, 2011 to
June 30, 2011. The agreement is filed in central files
with the County Clerk.

00 The Laramie County Commissioners met in regular
session Tuesday, April 5, 2011 at 3:30 p.m. Those in
attendance were Commissioner Diane Humphrey,

01 Commissioner Thompson moved to approve the Minutes
of Proceedings for March 15, 2011. Commissioner

02 Commissioner Woodhouse moved to approve warrants in
the amount of $4,023,774.43 for March 2011.
Commissioner Thompson seconded the motion, which

03 Commissioner Woodhouse moved to approve the
following part-time salaries in the amount of $37,075.14
for March 2011: Extension Agent, $2,033.93; Buildings &
Grounds, $10,552.64; Information Technology,
$2,304.00; County Clerk, $88.00; County Treasurer,
$3,497.45; Detention Facility, $9,529.12; District Court,
$4,750.00; County Coroner, $3,400.00; Drug Court,
$920.00. Commissioner Thompson seconded the motion,
which passed unanimously.

04 Commissioner Woodhouse moved to approve the
following fees collected by various County entities for
February 2011: County Clerk, $79,818.55; DUI Court,
$855.00; Drug Court, $525.00; Circuit Court, $85,232.00;
Planning and Development, $32,659.84; Clerk of District
Court, $17,938.13; Sheriff's Department, $59,430.28.
Commissioner Thompson seconded the motion, which

05 Commissioner Woodhouse moved to approve a resolution
to approve a waiver for the Direct Sub Grant Award
Juvenile Accountability Incentive Block Grant (FY 2010
JABO). Commissioner Thompson seconded the motion,
which passed unanimously. The resolution is filed in
central files with the County Clerk.

06 Commissioner Woodhouse moved to approve a renewal
agreement between Laramie County and Phoenix Fire
Protection for inspection and maintenance of the fire
system at the Laramie County Sheriff's Department and
Detention Facility in the amount of $14,238.54 to run July
1, 2011 through June 30, 2012. Commissioner
Thompson seconded the motion, which passed
unanimously. After obtaining all signatures, the
agreement is to be filed in central files with the County

07 Commissioner Woodhouse moved to approve a renewal
contract between Laramie County and the City of
Cheyenne for the housing of the City of Cheyenne Police
Department inmates in the Laramie County Detention
Facility in the amount of $80 per day per inmate and $26
per inmate per booking to run July 1, 2011 through June
30, 2012. Commissioner Thompson seconded the
motion, which passed unanimously. After obtaining all
signatures, the contract is to be filed in central files with
the County Clerk.

08 Commissioner Woodhouse moved to approve an
agreement among the State Transportation Commission
of Wyoming, Union Pacific Railroad Company, and
Laramie County, Wyoming under Project No. 1117001 to
demolish and remove an overpass structure carrying U.S.
Highway 30 at Railroad Milepost 525.78, DOT 810-256P
on Railroad's Laramie Subdivision, which is no longer
being used for highway traffic. Commissioner Thompson
seconded the motion, which passed unanimously. The
agreement is filed in central files with the County Clerk.

09 Commissioner Woodhouse moved to approve an
agreement between the Board of Public Utilities and
Laramie County for use of water treatment process
wastewater at the Sherard Water Treatment Plant.
Commissioner Thompson seconded the motion, which
passed unanimously. The agreement is filed in central
files with the County Clerk.

10 Commissioner Woodhouse moved to approve an
agreement between Laramie County and the Pine Bluffs
Police Department to provide one (1) Command Vehicle
to the Pine Bluffs Police Department in the amount of
$27,460 under the Wyoming Homeland Security General
HSGP 09 grant. Commissioner Thompson seconded the
motion, which passed unanimously. The agreement is
filed in central files with the County Clerk.

11 Commissioner Woodhouse moved to approve an
agreement between the Board of Public Utilities and
Laramie County for use of water treatment process
wastewater at Dry Creek. Commissioner Thompson
seconded the motion, which passed unanimously. After
obtaining all signatures, the agreement is to be filed in
central files with the County Clerk.

12 Commissioner Thompson moved to approve a resolution
approving the submission of a grant application to the
Wyoming Department of Agriculture for a Specialty Crops
Grant to provide a part-time, seasonal coordinator to
operate the Junior Master Gardner's Program in the
amount for $24,000 per year for two years with no match
required. Commissioner Woodhouse seconded the
motion, which passed unanimously. The resolution is
filed in central files with the County Clerk.

13 Commissioner Woodhouse moved to approve a resolution
approving the submission of a grant application to the
University of Wyoming College of Agriculture and Natural
Resources Cooperative Extension Service Competitive
Grant Program in the amount of $50,000 to provide
funding for a part-time, seasonal coordinator and other
costs of the Junior Master Gardner program for a three-
year period with no match required. Commissioner
Thompson seconded the motion, which passed
unanimously. The resolution is filed in central files with
the County Clerk.

14 Commissioner Thompson moved to approve an
amendment to the cooperative agreement (100601-15)
between Laramie County and the Wyoming Department of
Environmental Quality for the Lower Dry Creek Wetlands
Project for changes in funding allocations. (Changes in
funding allocation have been made to each of the three
budget items--$3,989.72 was moved from task 1 to tasks 1
and 3 of the original budget. Funding was reallocated
exclusively from the federal (319) funds. Funding from
non-federal cash matches is not changed via this
amendment. The overall project budget of $254,185
does not change as a result of this amendment.)
Commissioner Woodhouse seconded the motion, which
passed unanimously. The amendment is filed in central

15 Commissioner Woodhouse moved to approve a change
order from AP Wyoming for additional cost of site utilities
for the Juvenile Services Center in the amount of
$269,006 with 29% coming from the FY 2010 Consensus
Block Grant from SLIB and 71% from JJJPB bond
proceeds. Commissioner Thompson seconded the
motion, which passed unanimously. The change order is
filed in central files with the County Clerk.

16 Commissioner Thompson moved to approve a change
order from FCI Constructors, Inc., in the amount of
$139,184 for revisions to the oil pit at the Public Works

Facility at Archer Complex (remaining contingency funds
would be approximately $850,000 after this change
order). Commissioner Woodhouse seconded the motion,
which passed unanimously. The change order is filed in
central files with the County Clerk.

17 Commissioner Woodhouse moved to approve the third
addendum to the architectural design and construction
services contract (100817-11) between Laramie County
and EKM&P, Inc., the architects for the Juvenile Detention
Center, in the amount of $133,848 to be paid from
Juvenile Justice Services Joint Powers Board bond
proceeds pursuant to which EKM&P will provide facility
activation services necessary to ready the building for
occupancy and use. Commissioner Thompson seconded
the motion, which passed unanimously. The addendum is
filed in central files with the County Clerk.

18 Commissioner Thompson moved to approve a contract
between Laramie County and Sargent Drilling for
construction of the Archer 401 Well in the amount of
$85,499. Commissioner Woodhouse seconded the
motion, which passed unanimously. The contract is filed
in central files with the County Clerk.

19 County Clerk Debbye Lathrop presented a Seasonal
Fireworks Permit submitted by Jim Landis d/b/a USA
Fireworks located at 102 West College Drive, Cheyenne,
Wyoming. Chairman Humphrey opened the meeting as a
PUBLIC HEARING. James P. McNeil rose to speak against
the use and discharge of fireworks due their disruptive
nature. Hearing no further comment, the Chairman closed
the PUBLIC HEARING. Commissioner Woodhouse
moved to approve the permit application. Commissioner
Thompson seconded the motion, which passed
unanimously. Documentation is filed in central files with
the County Clerk.

20 Commissioner Thompson moved to approve a resolution
appointing Steve Secrest to the Laramie County Fair
Board to complete the term vacated by Brett Bauman,
which will expire on December 31, 2011. Commissioner
Woodhouse seconded the motion, which passed
unanimously. The resolution is filed in central files with
the County Clerk.

21 Bruce Perryman, AVI, PC, agent for the applicant,
presented a Preliminary Plat of Niobrara Energy Park
Subdivision, located in a portion of the North 1/2 of
Section 9, T.13N., R.66W., of the 6th P.M., Laramie
County, Wyoming. Mr. Perryman stated that the
developer agrees to the Planning Commission conditions
with modifications to condition number 5 and number 8.
Condition number 5 involves comments from Benchmark
Engineers and condition number 8 contradicts number 4
and is unclear; the developer would like to have condition
8 removed which would allow time for clarification prior
to the Final Plat. Gary Kranse presented the staff report
and recommended approval with the following conditions:
1) The alignment of the Allison Road extension shall not
go past the school, and a road connection north to Fox
Farm Road shall be resolved prior to submittal of the
Subdivision Permit; 2) Comments from the County
Assessor and Qwest Communications shall be addressed
prior to submittal of the Subdivision Permit; 3) The
applicant shall enter into a development agreement with
the County that addresses site infrastructure and
improvements as well as maintenance responsibilities
prior to plat recordation; 4) Pedestrian connectivity to the
proposed drainage facility shall be included with the
Subdivision Permit; 5) Comments from Benchmark
Engineers shall be addressed prior to submittal of the
Subdivision Permit; 6) Utility easements shall be located
along the front lot lines only; 7) The Development
Agreement shall be submitted with the final plat for
recordation; 8) Isolation shall be provided for pedestrians
from industrial traffic. The process was started under the
previous land use and subdivision permit regulations, but
does comply with those regulations as well as the new
land use regulations, which were adopted on February 15,
2011. There is a proposed Lot 23 that will be a retention
pond. Extension of Allison Road needs to be addressed
with WY-DOT prior to the Final Plat stage. The project
would include light industrial traffic, pipe storage, and
other activities related to the Niobrara oil play.
Consideration needs to be made to provide a secondary
access road to East Fox Farm Road to alleviate traffic
through the residential portion of the area. At the
suggestion of Commissioner Woodhouse, condition #8
could be modified to address safety concerns of pedestrian
traffic. Commissioner Thompson voiced concern about
the nature of the use in close proximity to an elementary
school. Public Works Director Don Beard stated the layout
of the greenway in the area did not include this property.
He also has concerns with the large truck traffic on Allison
Road as well as the confluence of three drainages and
any development within that drainage pathway will be
expensive, which will fall on the taxpayers and not private
enterprise. He supports the connection to East Fox Farm
Road. He supports the project overall as it is a good fit
with the industrial nature of the area. He believes all
issues can be resolved prior to the Final Plat stage.
Chairman Humphrey opened the meeting as a PUBLI C
HEARING. Nancy Olson, Metropolitan Planning
Organization, stated one of their mandates is to provide
transit, and they are requesting that sidewalks be included
for adults who are employed by businesses locating in the
park. James P. McNeil asked about the warranty deeds or
leases on the property. Chairman Humphrey responded
that the property was and may still be owned by the Reed
family. Hearing no further public comment, the
Chairman closed the PUBLIC HEARING. Mr. Perryman
stated that inclusion of sidewalks and connectivity to the
regional park has been requested by the City of
Cheyenne. The developer hopes to resolve those matters
prior to Final Plat. Commissioner Woodhouse moved to
acknowledge the Preliminary Plat with conditions 1
through 7 and modifying condition 8 to read, "address
safety concerns of pedestrians in areas of industrial traffic"
and adopt findings of fact a and b. Commissioner
Thompson seconded the motion, which passed
unanimously. Documentation is filed in central files with

22 Bruce Perryman, AVI Engineering, agent for the
applicant, presented a Preliminary Plat of the Overland
Trails Business Park located in a portion of the East 1/2 of
Section 14, T.13N., R.67 W., of the 6th P.M., Laramie
County, Wyoming. Mr. Perryman stated this was presented
in the past, but due to changes in economic climate it
has been held back until now as current conditions are
right to bring the Preliminary Plat forward. The developer
agrees to all the conditions recommended by the
Planning Commission. County Planner Gary Kranse
presented the staff report and recommended approval with
the following conditions: 1) The alignment of Etchepare
shall be updated to resolve comments from WYDOT prior
to submission of the Subdivision Permit application; 2)
Comments from the County Assessor and Qwest
Communications shall be addressed prior to submittal of
the Subdivision Permit; 3) The applicant shall enter into a
development agreement with the County that addresses
site infrastructure and improvements as well as
maintenance responsibilities prior to plat recordation; 4)
Any conflicts with existing road names shall be resolved
prior to submission of the Subdivision Permit application;
5) Utility easements shall be located along the front lot
lines only; 6) The Development Agreement shall be
submitted to the Planning Commission for review with the
subdivision permit application. Plan Cheyenne describes
this tract of land as best suited for mixed use commercial
(MU-C) and mixed use employment (MU-E). On-site storm
water management will be addressed with the required
site plan as each lot develops; however, an overall master
drainage plan for the property should be completed to
ensure that cumulative impacts from this project, including
discharges off site are properly managed. The layout of
the roads is being considered by the County, City, and
WYDOT. Don Beard, Public Works Director, stated the
County has historically taken on the responsibility of
maintaining easements, and the recommendation is
always to have a single easement for all utilities, etc.
Commissioner Thompson asked about the source of the
water. Mr. Kranse stated that initially there will be wells
located on some of the lots and in the future, the property
may be annexed into the City of Cheyenne and be
provided with city water. Mr. Perryman stated that there
will be a common sewage collection system with individual wells on each lot initially with city water
planned in 2014. Each individual lot owner will have the
choice to continue to use the well or switch over to city
water. Chairman Humphrey opened the meeting as a
PUBLIC HEARING. James P. McNeil rose to ask Mr.
Perryman if the developer had warranty deeds and water
rights for the property. Mr. Perryman responded that they
did. Hearing no further public comment, the Chairman
closed the PUBLIC HEARING. Commissioner Thompson
moved to acknowledge the Preliminary Plat of the
Overland Trails Business Park located in a portion of the
East 1/2 of Section 14, T.13N., R.67 W., of the 6th P.M.,
